Trusting Pixels Inc. – Terms & Conditions

1. Acceptance of Terms

By accessing or using any product, dashboard, application‑programming interface ("API"), report or other service (collectively, the "Services") offered by Trusting Pixels Inc. ("Trusting Pixels", "we", "our"), you ("Client", "you") agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not access or use the Services.

2. Accounts & Access

• Clients must be at least 16 years old (or the age of majority in their jurisdiction, if higher).
• You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.
• You shall provide accurate, complete information when opening or updating an account.

3. Licence & Permitted Use

• Trusting Pixels grants you a non‑exclusive, non‑transferable, revocable licence to access and use the Services during an active subscription or evaluation period.
• You may display retouch‑score results in internal dashboards or client deliverables only while the subscription is active and for up to 30 days after termination. Thereafter you must delete cached scores and cease display.
• Except as expressly permitted, you must not:
  • reproduce, resell, frame or mirror any part of the Services;
  • reverse‑engineer, decompile or attempt to discover source code or underlying models;
  • remove proprietary notices.

4. Fees & Payment

• Fees (if any) will be set out in an order form or invoice. By providing a credit‑card number or wire payment, you authorise Trusting Pixels (or its payment processor, e.g. Stripe) to charge all applicable amounts.
• Fees are non‑refundable except as required by law.

5. Service Availability & Support

• The Services are provided "as‑is" and "as‑available" without any guaranteed uptime. Support is offered by email only at info@trustingpixels.com.

6. Intellectual Property

• Trusting Pixels (and its licensors) retain all rights, title and interest in and to the Services, algorithms, models, trademarks and content.
• All client‑provided data remains your property. You grant Trusting Pixels a worldwide, non‑exclusive licence to process such data solely to provide and improve the Services.

7. Confidentiality

Each party agrees to protect the other’s non‑public information with reasonable care and use it only for the purposes of the Agreement.

8. Warranties & Disclaimers

• You understand that retouch scores are probabilistic estimates and not guarantees.
• To the maximum extent permitted by law, Trusting Pixels disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non‑infringement.

9. Limitation of Liability

• Cumulative liability of Trusting Pixels for all claims under these Terms shall not exceed CAD 5 000.
• Neither party is liable for indirect, consequential, special or punitive damages.

10. Indemnity

You will indemnify and hold Trusting Pixels harmless from claims arising out of (i) your misuse of the Services, (ii) content you provide, or (iii) your breach of these Terms.

11. Term & Termination

• Either party may terminate for material breach not cured within 30 days of notice.
• Upon termination, your licence ends and you must delete all score data within 30 days.
